BOOKING DEPOSIT AND COURSE FEES

For ENG Medicals confirmation of booking will be sent within a few days of the appointment.

At this time no deposit is required however,

 

1. Cancellations & Amendments

We understand that changes are inevitable and our goal is to be as helpful and as flexible as possible.
That said, we cannot be expected to work out of office hours to fill appointments that are cancelled in those hours.

Our terms and conditions for the cancellation of appointments are as below.

1.1 Cancellation of full Medical appointments, which start at 45 minutes duration are:

  • Cancellation of an appointment, by the client, when cancelled with more than 2 working days notice and within working hours there is no charge.
  • Cancellation within 2 working days notice and within working hours, there will be a charge of 50% of the amount due for the cost of the appointment/medical.
  • Last minute cancellation within 1 working day within working hours is charged at 100% charge of cost of the appointment/medical.
  • No Show is charged at 100% charge of cost of the appointment/medical. If you are more than 20 minutes late this is classed as a no show.

Club de Mar Medical receives no government subsidies to operate. When a customer no shows, it is a direct loss of income for us and additionally prevents us using that appointment for a patient who may very much need an appointment.

Lateness causes a knock
We reserve the right to inform the relevant authorities and work closely with our colleagues to inform each other of no shows and facilitate the smooth operation of our independent practices.

1.2 First aid Courses

  • With regard to First Aid Courses, If more than four weeks’ notice of cancellation is provided, the student can be transferred free of charge to a later date or their place on the course can be transferred to another student.
  • If the notice of cancellation is provided between four and one weeks before the commencement date, and Club de Mar Medical is unable to re-sell the place on the course, a cancellation fee of 50% of the course fee is due.
  • If less than one week’s notice of cancellation is provided, and Club de Mar Medical is unable to re-fill the place on the course, the full payment of the course fee shall be due.
  • Course fees shall not be refunded for any reason once the course has started. Please note, we recommend you take holiday cancellation or personal travel insurance. Notice of cancellation must be received in writing.

If CdMM has to cancel a course, before the commencement date, any course fees you have paid will be refunded in full.

No liability shall be attached to CdMM beyond refunding the course fee paid for the cancelled course or unused portion if the course has already started. No payments shall be made for incidental costs.

As above, we recommend you take holiday cancellation or personal travel insurance.

If a course has to be postponed, once it has commenced, due to any adverse issues beyond the control of CdMM, course fees will be transferred to a later date. Course fees are not refundable in such a case.

By booking with us you are agreeing to these practices and you will confirm your attendance or cancellation and agree to the payment terms.

 

2. PAYMENT

Payment can be made in cash, by bank transfer or with a credit or debit card in person. Bank transfers must be sent in euro currency and bank charges are for the account of the student. An invoice will be issued upon full payment. If sending a bank transfer please ensure the description of the transfer includes your name.

 

3. AFTERCARE

As a part of the Club de Mar Medical protocols, after your medical appointment or course has been completed, we keep the personal information that is strictly related to the patient records and or course and certificate you earn with us. We keep information stored on our system. For courses, this is in case a certificate is lost/stolen/destroyed, this is because we want to be able to support you in getting a replacement. You can request to delete your personal information from our system at any time, this may compromise any follow up or post appointment service.

 

4. REFUNDS

CdMM Nautical Academy shall not be responsible for any unused air tickets or unused portions of air tickets or unused services of any kind. Refunds are not provided on training fees, though fees paid may be transferred to other courses at the discretion of the principal.

 

5. DELAY OR FAILURE TO ARRIVE

If a student is likely to be delayed beyond the start time of the course, CdMM must be informed as soon as possible and must be notified in writing. It is at the discretion of CdMM if the fees paid can be transferred to a future course. If a student fails to arrive, for any reason whatsoever including illness, and CdMM has not been notified in writing, the course fee will be forfeited.

 

6. HEALTH POLICY

We ask you to inform us upon booking of any health issues that may affect your suitability for participating in any practical elements of the first aid course you have booked.

 

7. LIABILITY

No liability is accepted for student’s personal possessions left in our training room or premises; No liability is accepted for students whilst in, or on, any CdMM property. No liability is accepted for death, personal injury, damage, expense, or loss of any nature whatsoever sustained by any student other than in the case of proven negligence of CdMM at the time of the incident. All students take part in any course at their own risk. The act of signing for a training course, either through an actual signature of submitting the form electronically, implies that the student has understood and accepted the terms and conditions of CdMM herein, including the risk disclaimer above and liability as explained in this document.

 

8. FORCE MAJEURE

CdMM shall not be liable for any expenses incurred due to Force Majeure, including Act of God, weather conditions, strikes, and acts of Government, war, or any other occurrence beyond our control.

 

9. SMOKING

Smoking is not permitted within the premises of CdMM.

 

10. DRUGS

Recreational drugs of any kind are strictly forbidden in the premises of CdMM. If found, or suspected, the customer will immediately leave the course and no monies will be refunded, nor any additional travel expenses reimbursed.

 

11. STUDENT NEGLIGENCE

If irresponsible or negligent behaviour of a student leads to damage or loss of any item of CdMM Training equipment or to the premises, the student is responsible for replacement or repair. Students are requested to act with a duty of care and respect for our property and premises. Damages and breakages, howsoever caused, must immediately be notified to the staff present. Skipper/instructor or principal.

 

12. COMPLAINTS

Notice of any complaint should be made to CdMM staff at the time of the complaint arising. If the complaint cannot be resolved at that time, then a written complaint should be made to the office team at info@clubdemarmedical.com. A formal complaint, the student feels is still unresolved, should be made in writing to Dr Johanna Clark, Medical Director of CdMM and will be dealt with as a matter of importance.

 

13. INSTRUCTOR/EXAMINER’S DECISION

The instructor/examiner’s decision is final.

 

14. PERSONAL INSURANCE

It is strongly advised for students to obtain their own insurance for sickness, illness, loss of course fees, loss of personal effects, breakages or damages to the boat, cancellation or curtailment, travel disruption or delay, accident onboard, or any other reason the student considers appropriate for their activity and well-being.

 

15. CERTIFICATES

Certificates will only be issued at the end of a course if, in the opinion of the instructor/examiner, the student has reached the standard required. The decision is final and to be accepted by all students. In the event certificates cannot be issued immediately they will be forwarded, by post, to the address provided.

 

16. PERSONAL IDENTIFICATION

It is according to Spanish law that photographic identification is to be carried by all persons at all times.

 

17. COURSE DURATION

All courses start in the CdMM premises at 0830 unless otherwise notified.

 

18. INSURANCE

Whilst CdMM carries full public liability insurance you should satisfy yourself that you are covered for personal injury and cancellation.

 

19. PHOTOGRAPHS USED IN PROMOTIONAL MATERIAL

You agree that any photographs that are taken during training, that may feature you, can be used by CdMM for promotional purposes. In the event that the company is sold, the new owner would have the rights to all photographs and promotional material obtained by CdMM.

 

20. UNDER 18S

Under 18s can be accepted for Medical Courses provided all requirements of the courses have been met.

All booking forms for under 18’s to be signed by parent or guardian, stating this fact after the signature.

 

21. DISPUTES

Any dispute should be brought to the attention of CdMM at the earliest opportunity to be resolved. In the event of a dispute not being settled by mutual agreement, it is agreed that this agreement (contract) shall be governed by the laws of Spain and the parties submit to the non-exclusive jurisdiction of the courts of Palma de Mallorca. It is further agreed that all agreements between customers, clients and students, and staff of CdMM Academy shall be governed by Spanish Law, even when the dispute occurs outside Spanish territorial waters.

 

22. Maritime and costal agency (MCA)

CdMM is an agent of the MCA providing MCA courses and medicals and is subject to regular inspections to ensure the quality of services and training.
